Welcome to PixGo.org ("Platform", "Service"), a partner service of the DePix ecosystem. These Terms and Conditions of Use ("Terms") govern your access and use of our services, focused on providing autonomy, speed and control over your receipts.
By registering or using our services, you ("User", "You") declare that you have read, understood, and fully agree with these Terms. If you do not agree with any part of these Terms, please do not use the Platform.
1. Service Purpose
PixGo.org offers a technological interface that allows the User (whether a merchant, liberal professional, freelancer, MEI, or any other individual or legal entity) to generate digital charges that can be paid by third parties ("Payers") through the PIX system of the Central Bank of Brazil.
IMPORTANT: PixGo.org is NOT a payment institution and DOES NOT process PIX transactions directly. The processing of all PIX payments is carried out by payment institutions and technology partners duly authorized and regulated by the Central Bank of Brazil, contracted and defined by PixGo.org. The issuance of DEPIX tokens is performed by Eulen, responsible for issuing DePix in Brazil. PixGo.org acts exclusively as a technological interface, consuming the APIs of these partners to offer an integrated management experience.
After the PIX payment confirmation (processed by our regulated payment partners), the amount is converted into the DEPIX digital asset issued by Eulen. For security and fraud prevention reasons, DEPIX tokens are temporarily held in PixGo.org's custody wallet and automatically settled to the Liquid wallet informed and validated by the User in D+1 (the day after receipt, in calendar days, including weekends and holidays), always at the end of the day. During this period, you can track all your receipts in real-time through the dashboard and generate detailed reports.
PixGo acts as a technological facilitator, not being a financial institution or regulated payment service provider. All banking compliance, KYC (Know Your Customer), AML (Anti-Money Laundering), and PIX payment processing are the exclusive responsibility of the regulated payment partners, who hold the necessary Brazilian regulatory authorizations.
1.5. Merchant Disclosure Obligation
IMPORTANT MERCHANT OBLIGATION: If you are a merchant, service provider, or any entity that receives payments from end customers through PixGo, you are obligated to clearly inform your customers that when making a PIX payment, they are actually purchasing DEPIX stablecoins (pegged 1:1 to the Brazilian Real) and that PixGo acts as an intermediary facilitating the conversion from PIX to stablecoin through our technological partners. This disclosure must be made in a clear and transparent manner before the payment is processed, ensuring that the customer understands the nature of the transaction. Failure to provide this information may result in account suspension.
2. User Registration and Account
2.1. Eligibility and Information Accuracy
To use the Platform, you declare to be over 18 years old and have full legal capacity to enter into contracts. You agree to provide true, accurate, current, and complete information during the registration process (such as username, valid email address, and optional contact) and to keep this information updated.
2.2. Account Security
The confidentiality of your password and the security of your account access are your sole responsibility. You agree to immediately notify PixGo of any suspicion or unauthorized use of your account or any other security breach through the email [email protected].
2.3. Liquid Wallet Validation
The correct provision and validation of a Liquid Network compatible wallet address in your profile is an essential condition for generating charges and receiving the corresponding amounts. The security of this external wallet, including the safekeeping of private keys and backups, is your total and exclusive responsibility.
3. Next-Day Settlement Process and Temporary Custody
3.1. Temporary Custody for Security
After PIX payment processing by our regulated payment partners and conversion to DEPIX tokens, PixGo.org temporarily holds the tokens in secure custody wallets in the United States. This temporary custody is an essential security measure to:
- Prevent fraud and ensure transaction authenticity;
- Allow reversal in cases of proven fraudulent transactions;
- Consolidate multiple transactions to optimize network fees;
- Ensure compliance with security and anti-money laundering procedures.
3.2. Settlement Period
The settlement of DEPIX tokens to your registered Liquid wallet occurs on the next day after receipt, including weekends and holidays, always at the end of the day (US Mountain Time Zone).
3.3. Real-Time Monitoring
During the temporary custody period, you can:
- Track all received payments in real-time through the dashboard;
- View the status of each transaction;
- Generate detailed reports of your transactions;
- Check the pending settlement balance.
3.4. Custody Security
PixGo.org's custody wallets utilize industry security standards, including cold wallet storage, multi-signature, and strict access control procedures. However, you acknowledge that no system is completely inviolable and accept the inherent risks of temporary digital asset custody.
4. Platform Use and Zero Tolerance Policy
4.1. Lawful Purpose
You agree to use the Platform exclusively for lawful purposes, i.e., to receive payments from third parties via PIX in exchange for legitimate goods or services, and convert them into the DEPIX digital asset, as described in Clause 1.
4.2. Strictly Prohibited Activities
It is strictly prohibited to use PixGo for, or in connection with, any activities that are illegal, fraudulent, or violate these Terms. PixGo adopts a ZERO TOLERANCE policy against the following activities:
- Money Laundering and Terrorism Financing: Any act aimed at concealing or disguising the origin, location, disposition, movement, or ownership of assets, rights, or values derived, directly or indirectly, from a criminal offense, or financing terrorist activities.
- Fraud, Scams, and Illicit Schemes: Using the Platform to deceive third parties, obtain undue payments, or participate in any fraudulent scheme.
- Activities Related to Child Exploitation and Abuse: The production, distribution, storage, sharing, or acquisition of child sexual abuse material is a heinous and unacceptable crime. Accounts involved will be immediately terminated, and information may be reported to authorities.
- Illicit Trafficking: Commercialization or facilitation of transactions involving illicit drugs, firearms, ammunition, explosives, controlled products, human organs, wild animals, or any other item whose trade is prohibited by law.
- Violation of Sanctions and Embargoes: Conducting or facilitating transactions that violate economic sanctions imposed by international bodies or applicable national laws.
- Commercialization of Illegal Products/Services: Sale of counterfeit, stolen, smuggled products or those that infringe third-party intellectual property rights.
- Other Illegal Activities: Any other conduct that violates applicable laws, decrees, regulations, or norms in the User's or Payer's jurisdiction.
- Violation of these Terms or the terms of use of partner services, such as Eulen.
4.3. Monitoring, Suspension, and Summary Termination
PixGo reserves the right, at its sole discretion and without obligation, to monitor activities on the Platform to verify compliance with these Terms and identify suspicious activities. Any User account reasonably suspected or proven to be involved in any of the prohibited activities listed in Clause 4.2 (or other serious violations of these Terms) will be IMMEDIATELY SUSPENDED AND/OR PERMANENTLY TERMINATED, without prior notice, recovery of platform data, or any type of compensation.
The identification of potentially illicit activities may lead to cooperation with competent police and judicial authorities, within the limits permitted by applicable law and the technological characteristics of the service.
5. Privacy and Data Processing
We collect and process a minimal set of personal data necessary for the operation of the Platform, such as username, email, optional contact information, and access and transaction logs. This data is stored on servers located in the United States and is used exclusively to manage your account, process transactions, and ensure service security.
Payer identification data (KYC) and sensitive banking information are collected and processed exclusively by the regulated payment partners, following applicable privacy and data protection regulations in Brazil. PixGo.org does not have access to sensitive banking data of payers.
During the temporary custody period (next day), we maintain detailed records of all transactions for security, fraud prevention, and to allow you to track your receipts in real-time through the dashboard. After the settlement of DEPIX tokens to your wallet, we only retain historical records necessary for accounting and compliance purposes.
We do not share your personal data with third parties for marketing purposes. Sharing will only occur if we are required by United States federal or state law or a court order from our jurisdiction, especially in investigations of proven illicit activities, always respecting applicable legal limits.
The privacy of your final DEPIX balance, after settlement to your personal wallet, is an inherent feature of the Liquid Network technology. It is your responsibility to understand how this network works, adopt good security practices (such as using non-custodial wallets and protecting your keys), and manage your privacy on the blockchain. PixGo has no control over the Liquid Network or the information registered on it after settlement to your wallet. This technical feature does not grant anonymity, does not remove the identification required by the regulated partners and does not change your tax obligations.
We recommend reading the privacy policies of our payment partners (for PIX processing) and of Eulen (for DEPIX issuance).
6. Fees and Tax Obligations
The use of the PixGo Platform may be subject to service fees. Such fees, when applicable, will be clearly informed to the User before the confirmation of any operation involving them, or will be detailed in specific plans or agreements. All fees are charged in DEPIX tokens and processed from our headquarters in the United States.
IMPORTANT REGARDING TAX OBLIGATIONS: PixGo.org is an American company that operates exclusively under United States law. You are solely and exclusively responsible for calculating, declaring, and collecting all taxes, fees, and contributions that apply to the amounts received through the Platform in your local jurisdiction, including:
- Taxes on amounts received in PIX before conversion to DEPIX;
- Capital gains taxes on the appreciation or sale of DEPIX tokens;
- Any other applicable taxes in your jurisdiction (such as IRPF/IRPJ, PIS, COFINS, ISS in Brazil, or equivalents in other countries);
- Reporting obligations to local tax authorities regarding crypto-asset transactions.
PixGo.org does not provide tax or financial advice and has no knowledge of tax laws in jurisdictions outside the United States. It is your responsibility to consult a qualified professional in your jurisdiction to ensure compliance with all local tax obligations. The use of our services does not exempt you from your tax responsibilities in your jurisdiction.
7. Intellectual Property
The name "PixGo", the logo, user interface, visual design, texts, graphics, and underlying software of the Platform constitute intellectual property of PixGo or its licensors, protected by copyright and industrial property laws. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Platform strictly in accordance with these Terms.
Any unauthorized use, including reproduction, modification, distribution, or reverse engineering, is strictly prohibited.
8. Limitation of Liability and Disclaimers
The PixGo Platform is provided "as is" and "as available", without warranties of any kind, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted performance.
PixGo is not responsible for:
- Failures, congestions, delays, or operational instabilities of the Liquid Network or the Central Bank of Brazil's PIX system.
- Price volatility or loss of value of the DEPIX digital asset during the next-day temporary custody period.
- Loss of access, theft, or compromise of your external Liquid wallet and associated private keys after token settlement.
- Errors made by the User when providing data (such as Liquid wallet address) or operating the Platform.
- Actions, omissions, or commercial disputes between the User and Payers.
- Service interruptions caused by factors beyond our reasonable control (force majeure, cyber attacks, third-party infrastructure failures).
- Any financial losses, direct, indirect, incidental, special, consequential damages, or lost profits arising from the use or inability to use the Service.
- Compliance with your tax, fiscal, or regulatory obligations in any jurisdiction.
- Delays in next-day settlement caused by exceptional circumstances beyond our control.
During the next-day temporary custody period: PixGo employs industry-standard security measures to protect DEPIX tokens temporarily held in our secure custody wallets located in the United States. However, you acknowledge that no system is completely invulnerable and accept the inherent risks of temporary custody of digital assets.
PixGo's total liability to you, for any reason and regardless of the form of action, shall be limited, to the maximum extent permitted by United States federal law and applicable state laws, to the amount of fees actually paid by you to PixGo for the services that gave rise to the claim, in the 3 (three) months prior to the event.
9. Relationship with APIs and Payment Processing
PixGo.org operates exclusively as a consumer of APIs provided by technological and financial partners. It is essential that you understand the following points:
- PIX Processing: All PIX payment processing is performed by payment institutions and technology partners duly authorized and regulated by the Central Bank of Brazil, contracted and defined by PixGo.org.
- DEPIX issuance by Eulen: The conversion of PIX received amounts into DEPIX tokens (stablecoin pegged 1:1 with the Brazilian Real) is performed by Eulen, the entity responsible for issuing DePix in Brazil.
- Compliance and KYC: All identity verification (KYC), anti-money laundering (AML), and regulatory compliance are performed by the regulated payment partners, following the regulations of the Central Bank of Brazil and applicable Brazilian legislation.
- Chargebacks and Disputes: Suspicious or fraudulent transactions are handled directly by the regulated payment partners, which have the autonomy to chargeback PIX payments to the originating account when necessary.
- We are not a payment institution: PixGo.org is not regulated as a payment institution by any regulatory body. We operate only as a technological interface that integrates different APIs.
- Third-party dependency: Our service depends entirely on the availability and operation of the APIs of our payment partners and of Eulen. Interruptions in these services may affect our platform.
- Limited liability: PixGo.org is not responsible for failures, errors, or unavailability of third-party APIs or their services.
By using our services, you acknowledge and accept that you are, indirectly, using the services of regulated payment partners (for PIX processing) and of Eulen (for DEPIX issuance), and you must be aware of the terms and conditions applicable to these platforms.
10. Disclaimer - PIX Processing
IMPORTANT NOTICE: PixGo.org has no control, responsibility, or direct involvement in the processing of PIX payments. You expressly acknowledge and agree that:
- All PIX transactions are processed exclusively by payment institutions regulated by the Central Bank of Brazil;
- PixGo.org does not have access to bank accounts, does not move funds in Brazilian Real (BRL), and does not participate in the Brazilian Payment System (SPB);
- Issues related to PIX failures, transaction limits, banking system operating hours, or problems with financial institutions should be directed to PixGo.org support, which forwards them to the responsible payment partner;
- PixGo.org is not responsible for chargebacks, disputes, or investigations related to PIX payments;
- In case of suspected fraud or illicit activity, the regulated payment partner has full autonomy to block, chargeback, or report transactions to the competent authorities, without the need for authorization from PixGo.org.
You agree to indemnify and hold PixGo.org harmless from all liability, claims, losses, or damages related to the processing of PIX payments, acknowledging that such matters are the sole responsibility of the financial institutions involved.
11. Modifications to Terms
We reserve the right to modify these Terms at any time, at our sole discretion. We will notify you of significant changes by posting the updated version on the Platform, updating the "Last Updated" date at the top of this document, and/or sending a communication by email (if provided).
It is your responsibility to periodically review these Terms. Continued use of the Platform after the publication of changes will constitute your tacit acceptance of the new Terms. If you do not agree with the modifications, you must immediately cease use of the Platform and close your account.
12. Applicable Law and Dispute Resolution
PixGo.org operates as an international technology company headquartered in Wyoming, United States. Our operations, servers, technological infrastructure, and custody wallets are managed from our headquarters in the United States, and we operate in full compliance with United States federal laws and applicable state laws.
IMPORTANT: Although our website and interface are available in Brazilian Portuguese to facilitate access and understanding for Portuguese-speaking users, this translation is offered only as a courtesy and convenience. The availability of the website in Portuguese does NOT establish legal, operational, or jurisdictional presence in Brazil or any Portuguese-speaking country. PixGo.org operates as an international technology company without local business registration, physical establishment, bank account, employees, or any type of operation in Brazil.
These Terms shall be governed and interpreted exclusively in accordance with the laws applicable to our jurisdiction, regardless of the language in which you access our services. You expressly acknowledge and agree that:
- You are contracting services from an international technology company, subject to applicable international laws;
- Temporary custody of DEPIX tokens occurs in secure custody wallets located in the United States;
- Any dispute will be resolved under the applicable jurisdiction of our operations;
- It is your responsibility to verify whether the use of our services is permitted in your local jurisdiction.
Given the international nature of the service, you are solely responsible for verifying and ensuring that the use of our services complies with the laws and regulations of your own jurisdiction. PixGo.org operates as an international technology platform and makes no representations about the legality of its services in specific local jurisdictions.
In the event of a dispute arising from these Terms or the use of the Service, the parties agree to attempt to resolve the matter amicably. If this is not possible, any dispute shall be resolved exclusively by confidential arbitration under internationally recognized arbitration rules, to be conducted digitally or in a mutually agreed location. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.
By accepting these Terms, you expressly acknowledge the international nature of our services and irrevocably agree to the jurisdiction and dispute resolution mechanisms outlined herein for any matter that cannot be resolved by arbitration.
13. API Integration, Payer Data Linking and Reporting
When you create and use an API key to generate charges and receive payments through PixGo, in addition to the general rules of these Terms, the following conditions apply specifically to your integration:
- Payer data linking: Each payment processed through your API key has the payer's identification data (such as name and tax identification — CPF/CNPJ — provided by the banking partner at the moment of the PIX) linked to your account and to the corresponding API key. This link is permanent and serves audit and traceability purposes.
- Data storage: You expressly acknowledge and agree that PixGo.org stores and retains this payer identification data, together with the transaction metadata (amount, date, status, charge identifier and destination wallet), for as long as necessary to comply with security, anti-fraud, accounting and legal obligations.
- API approval and KYB: The release of an API key for receiving payments is subject to our review and approval, which may include business verification (KYB) and an initial validation deposit. PixGo may approve, deny, suspend or revoke an API key at its sole discretion.
- Your responsibility as the integrator: You are responsible for the lawful use of your API key, for safeguarding its credentials, and for clearly and transparently informing your payers that the transaction data is processed and stored as described herein.
REPORTING: You expressly acknowledge and agree that PixGo.org may, at its sole discretion and whenever it deems necessary or when required by applicable law, report the linked payer data and any suspicious, fraudulent or unlawful activity identified in connection with your API key to the competent authorities, regulatory bodies and to our banking and technology partners, regardless of prior notice. This reporting is an essential anti-fraud and legal-compliance measure and does not give rise to any right to compensation.
